Off plan: Possibility of a two-year building extension on plots of less than 4 acres -2022

At a two-year extension of the building permit in plots of land less than 4 hectares in areas outside the plan oriented the Ministry of Environment and Energy, which is considering putting the brakes on the suspension of pre-approvals of building permits from 2023, as provided for in the Legislation.

As it seems the Ministry is seriously considering to proceed to extend the possibility of building "freezing" essentially the relevant prohibition of pre-approval building permits, which, under the current arrangements, expires in six months.

Although there have been no clear announcements yet, the ministry seems ready to align the possibility of pre-approvals with urban planning, which is expected to be completed at the study level in 2025. In practice, this means an extension for at least two years and possibly longer, as it will most likely cover the period of time required for the adoption of the relevant Presidential Decrees for each region.

It is recalled that under the existing legislation, building on off-plan plots will be permitted on a transitional basis for a period of two years from the pre-approval of the building permit, but which must be taken by December 2022 at the latest. On December 9, 2022, the deadline to apply for a building permit for plots of less than four acres (4000sqm) that with the current derogations were complete and buildable will expire.
